You may use the Service only if you are at least 18 years old (or the age of legal majority in your jurisdiction, whichever is higher) and have the legal capacity to enter into a binding contract. By using the Service you represent and warrant that you meet these requirements and that you are not barred from receiving services under the laws of any applicable jurisdiction, including any applicable sanctions, export-control or embargo regimes.
You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials and API keys, and for all activity that occurs under your account. You must notify us immediately of any unauthorised use. We are not liable for any loss arising from your failure to safeguard your account.
One person or entity may not maintain multiple accounts to evade limits, suspensions or promotional restrictions. We may refuse registration, or close any account, at our discretion.
resify provides access to proxy connectivity (including residential, mobile, datacenter and unlimited offerings) together with a dashboard, usage analytics and related tooling. The Service routes your network requests through third-party IP resources. We provide access to network capacity; we do not control, host, originate or endorse the content you transmit or receive through it.
Features, capacity, locations, IP pools, pricing and limits are provided on an evolving basis and may change, be added or be withdrawn at any time. Any figures, performance metrics, IP counts, country counts, uptime or latency statements shown on our marketing pages are estimates and aspirational targets, not guarantees or contractual commitments.
This Acceptable Use Policy ("AUP") is part of these Terms. You agree that you will not use the Service, and will not permit anyone else to use the Service, to engage in, facilitate, or attempt any of the following:
You are solely responsible for determining whether your intended use is lawful in every jurisdiction relevant to that use, including the jurisdiction in which your target resources are located. Legitimate uses such as web data collection, ad verification, price monitoring, brand protection and quality assurance are permitted only to the extent they comply with this AUP and all applicable law.
You retain full and sole responsibility for all traffic, requests, content and data that you transmit, request, receive, store or process through the Service, and for the consequences of doing so. We do not pre-screen, monitor, edit or control the content of your traffic, and we have no obligation to do so.
You acknowledge that we act solely as a provider of network connectivity and that you, not resify, are the party determining the purpose and means of your use. To the maximum extent permitted by law, you assume all risk arising from your use of the Service and you agree that any liability for your activity rests entirely with you.
The Service operates on a prepaid basis. You add funds to an account balance and apply that balance to plans and bandwidth. All prices are stated exclusive of any taxes, duties or levies, which are your sole responsibility. You are responsible for determining, reporting and paying any taxes applicable to your purchases and use.
Payments are processed by independent third-party payment providers. We do not control, and are not responsible for, the availability, fees, timing, security or conduct of those providers. Once a payment or top-up is confirmed it is credited to your balance.
All sales are final. Except where a non-waivable right to a refund is required by applicable law, account balances, plan purchases, bandwidth, time-based plans, redeemed keys and promotional credits are non-refundable, non-returnable and non-exchangeable, and cannot be redeemed for cash. Balances have no monetary value outside the Service. We do not offer refunds for unused bandwidth or remaining time, for plans that did not meet your expectations, or for accounts suspended or terminated for breach of these Terms.
We may change pricing, volume tiers, discounts and plan structures at any time. Price changes do not apply retroactively to bandwidth or time already purchased. We may correct any error in pricing or billing, including reversing credits applied in error. We may set, and adjust, minimum purchase amounts and other limits at our discretion.
We aim to keep the Service available and performant, but we do not guarantee uninterrupted, error-free, secure or timely operation. The Service may be unavailable from time to time due to maintenance, upgrades, capacity constraints, network conditions, actions of third parties, or events beyond our reasonable control. Marketing statements regarding uptime, speed or coverage are targets and do not constitute a service-level guarantee unless expressly agreed in a separate written agreement signed by us.
We may modify, suspend or discontinue any part of the Service, in whole or in part, at any time, with or without notice.
We may suspend, restrict, throttle or terminate your access to the Service, in whole or in part, immediately and without prior notice, if we reasonably believe that:
You may stop using the Service at any time. Upon termination for breach, you forfeit any remaining balance, bandwidth or plan time without refund, to the extent permitted by law. Sections that by their nature should survive termination — including those on responsibility for traffic, payments already made, disclaimers, limitation of liability, indemnification, and governing law — survive.
The service is provided "as is" and "as available", with all faults and without warranty of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied, statutory or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Service will meet your requirements, that any particular IP, location, speed, success rate or result will be achieved, that defects will be corrected, or that the Service is free of harmful components. Any material obtained through the Service is accessed at your own discretion and risk.
To the maximum extent permitted by applicable law, in no event will resify or its operator, affiliates, suppliers or licensors be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or anticipated savings, arising out of or relating to the Service or these Terms, whether based in contract, tort (including negligence), strict liability or any other theory, even if advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the total amount you actually paid to us for the Service during the three (3) months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow certain exclusions or limitations; in those jurisdictions our liability is limited to the smallest extent permitted by law.
You agree to defend, indemnify and hold harmless resify, its operator, and their respective affiliates, officers, agents, infrastructure and service providers, and licensors from and against any and all claims, demands, investigations, liabilities, damages, losses, fines, penalties, costs and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your traffic, content or data; (c) your violation of these Terms, the AUP, or any law; or (d) your violation of the rights of any third party. We may assume the exclusive defence and control of any matter subject to indemnification, in which case you agree to cooperate.
The Service relies on upstream networks, IP resources, datacenters, payment processors and other third-party providers. We do not control these third parties and are not responsible for their acts, omissions, availability, pricing or policies. Your use may also be subject to the terms of third parties whose systems you interact with, and you are responsible for compliance with them. The identity and configuration of our upstream providers are confidential and are not part of the Service offered to you.
The Service, including the website, dashboard, software, design, text, graphics, logos and the "resify" name, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose, subject to these Terms. You may not copy, modify, reverse-engineer, resell, sublicense, or create derivative works from the Service except to the extent expressly permitted by law. You retain ownership of your own content.
Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you consent to the processing described there. You are responsible for ensuring that your own use of the Service complies with all data-protection and privacy laws applicable to you and to the data you process.
These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws applicable at the place of business of the operator of the Service, without regard to conflict-of-law principles, and excluding the United Nations Convention on Contracts for the International Sale of Goods.
The parties will first attempt to resolve any dispute informally by contacting us. If a dispute cannot be resolved informally within thirty (30) days, the parties agree that the dispute will be resolved on an individual basis, and, to the maximum extent permitted by applicable law, you and we each waive any right to a jury trial and to participate in any class, collective or representative action. Nothing in this section prevents either party from seeking injunctive or equitable relief to protect its intellectual property or to address unauthorised use of the Service.
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Changes take effect when posted, unless a later effective date is stated. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to a change, you must stop using the Service.
Entire agreement. These Terms, together with the Privacy Policy and any policies referenced herein, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
Severability. If any provision is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition or sale of assets.
Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, war, civil unrest, labour disputes, governmental action, network or power failures, or actions of third-party providers.
Relationship. Nothing in these Terms creates any partnership, joint venture, agency or employment relationship between you and us.
Notices. We may provide notices to you by email, through the dashboard, or by posting on the website. You consent to receiving communications electronically.
